This paper discusses the Kenyan constitutional and legal framework for the enforcement of county laws. It exposes the inadequacy of the legal and institutional framework as the root of all other challenges experienced in the enforcement of county laws in Kenya. These challenges include lack of capacity for the enforcement of county laws by the counties, corruption menace, lack of a uniform code of conduct for county askaris, the novelty of devolution to county askaris and the general public and the lack of county courts to resolve disputes involving counties and enforce county laws. Proposals for addressing these challenges are given stressing on the need to enact legislation to provide for the legal and institutional framework for the enforcement of county laws in Kenya. This is important because one of the ways through which the objects of devolution can be achieved in Kenya is through the effective and efficient enforcement of county laws and regulations.

Kenya adopted a new Constitution on 27th August 2010 with devolution1 being one of its most transformative aspects. Devolution was a good solution to the problems of marginalization, inadequate service delivery and regional disparities in development which was associated with the highly centralized system of government. With devolution, two levels of government were created: national and county governments.

The primary objective of this article is to critically examine the Kenyan constitutional and legal framework for the enforcement of county laws. It aims to identify the root causes of challenges in this sector—most notably the inadequacy of current legal and institutional frameworks—and proposes legislative solutions to ensure that the goals of devolution are effectively achieved.

3.1 Inadequate legal and institutional framework

As it emerged in the Part II if this study, a few county governments have enacted legislation providing for a legislative and institutional framework for the enforcement of and compliance with county laws and regulations. Mombasa, Nairobi City and Nakuru counties are good examples. Other counties have not enacted county legislation for the same purpose. Instead, their respective County Public Service Boards have employed security officers and/or security wardens and/or security enforcement officers and/or county laws enforcement officers popularly referred to as county askaris whose responsibility is to ensure compliance with and enforcement of the county laws and regulations. These county askaris work under the department of devolution, public service and disaster management. This clearly shows that most county governments lack legal and institutional frameworks for ensuring effective and efficient enforcement of and compliance with county laws and regulations.

For the effective and efficient enforcement of the county laws and regulations, it is proposed that the county assemblies of the respective county governments should enact county legislation providing both the legal and institutional frameworks for the enforcement of the county laws and regulations. The proposed legislation should provide for departments or units within the respective county public service and provide for their organization, functions and powers.
