3.0 The NESREA (national enforcement standards and regulations enforcement agency) act 2007

After the incident in Koko village, the environmental law regime suffered certain challenges ranging from lack of adequate manpower to incoherence as a result of multiple agencies amongst others. In particular, the federal environment protection agency suffered serious drawbacks some of which resulted from lack of community based approach and weak enforcement of existing laws. In 1999, in order to achieve coherence, the government merged the federal environmental protection agency and departments from other ministries into a single ministry, the federal ministry of environment. However, the new ministry lacked laws to enable enforcement. This created a vacuum. As a remedy, in line with Section 20 of the Constitution of the federal republic of Nigeria, the National Environmental Standards and Regulations Enforcement Agency (NESREA), Nigeria’s lead environment protection agency was established as a parastatal of the Federal ministry of Environment in order to ensure a cleaner and healthier environment for Nigerians. The National Environmental Standards and Regulations Enforcement Agency Act 2007 is the legal basis for the establishment of NESREA. The NESREA Act was amended in 2018 by the National assembly of the Federal republic of Nigeria to accommodate changes in the conditions of appointment of council members, and stiffer penalties for defaulters and related matters.
