A crescente relevância da publicidade médica nas redes sociais e nos meios digitais trouxe novos desafios para a regulação ético-profissional da medicina. Embora a proteção do paciente, a veracidade das informações em saúde e a preservação da confiança social na profissão constituam finalidades legítimas, a aplicação de normas de conteúdo aberto deve observar os limites jurídicos do poder sancionador.
Este estudo analisa a regulamentação brasileira da publicidade médica, com especial atenção à Resolução CFM nº 2.336/2023, sob a perspectiva do Direito Administrativo Sancionador. A partir da análise normativa, doutrinária e jurisprudencial, examina questões como tipicidade, responsabilidade subjetiva, imputação de atos praticados por terceiros, interpretação de conceitos jurídicos indeterminados, distinção entre informação e publicidade, lesividade e proporcionalidade. Ao final, propõe cinco critérios interpretativos destinados a conciliar a efetividade da regulação e a proteção do paciente com as garantias fundamentais que limitam o exercício do poder sancionador.
The growing importance of medical advertising on social media and digital platforms has created new challenges for the ethical and professional regulation of medicine. While patient protection, the accuracy of health information, and public trust in the medical profession are legitimate regulatory aims, the application of broadly framed rules must respect the legal limits of sanctioning power.
This study examines Brazilian medical advertising regulation, with particular attention to Federal Council of Medicine Resolution No. 2.336/2023, from the perspective of administrative sanctioning law. Drawing on regulatory provisions, legal scholarship, and case law, it addresses typicity, fault-based liability, attribution of third-party conduct, interpretation of indeterminate legal concepts, the distinction between information and advertising, harmfulness, and proportionality. Finally, it proposes five interpretative criteria aimed at reconciling effective regulation and patient protection with the fundamental guarantees that limit the exercise of sanctioning power.
