2.2 ASEANs Interpretation of non-intervention

After having formulated the key purpose and meaning of the principle of non-intervention, the specific meaning for the Association of Southeast Asian Nations needs to be differentiated form the definition stated by the International Court of Justice. This is especially important, since ASEAN does not define the principle of non-intervention in its own Charter and following agreements and rather does refer to the principle of non-interference. Therefore, even though one might be build on another, these principles have different meanings and implications. Hence, it is important to consider various factors, like history and culture, while portraying ASEAN’s non-interference principle and its potential differences in correlation to the non-intervention principle as understood in International Law and defined by the United Nations.

While the principle of non-interference is adopted by many organizations around the world and is even enshrined in the Charter of the UN, what appears to be unique to ASEAN’s conduct of regional relations is not only the adoption of non-interference as a behavioral norm, but rather its particular understanding and the subsequent practices of this norm (Katsumata, 2003).

These practices include refraining from criticizing actions of member states governments towards its own people as well as violation of human rights, abstain from making domestic political systems of states and the political constituency of governments a basis for deciding their membership in ASEAN as well as criticizing the actions of states, which were deemed to have breached the non-interference principle, like denying recognition, sanctuary, or other forms of support to any group seeking to destabilize or overthrow the government of a ASEAN member state or providing political support and material assistance for subversive and destabilizing activities of other member states (ASEAN, 2009). These principles have safeguarded the intergovernmental organizations common interests and formed the cornerstone for the development of mutual trust among their members. Furthermore, through the enshrined principle of non-intervention into all fundamental and legally binding documents the intergovernmental organization established a modus vivendi, which is determined to ensure its stability and security form external interference as well as the aversion of internal interference into domestic matters (Acharya, 2010).
